UPDATED:   COVID-19 Policy and Procedures in place from The Roknich Law Firm

Governor DeSantis has issued an executive order addressing essential services and activities during the COVID-19 emergency. The Governor’s order specifically states that “residential and commercial real estate services, including settlement services” is essential and a critical infrastructure workforce.

In compliance with the Governor’s order, the Roknich Law Firm will remain open and operating.

Our firm is on the leading edge of technology and is able to offer remote online notarization. This procedure is new to our industry and the technology is still being refined, however, we are now able to close transactions, including loan signings, with the signors sitting in their home.

Because remote online notarization is still in the early stages the process for the signor is cumbersome, but for many this may be the best choice since they will not need to leave home.

We still prefer to notarize documents in the presence of the signor, and we will continue to complete transactions in our office, or by mail where the signor can go to a notary. However, having the ability to close transactions remotely means that the current situation will not keep us from closing transactions.

We are vigilantly maintaining a clean environment making sure surfaces are disinfected before and after in-person signings as well as cleaning all touched surface (pens, copier, etc.). Buyers and Sellers are kept separate and the number of people in a signing is limited to only the necessary signors. The building courtyard makes social distancing as pleasant as can be under the circumstances. 

The importance of using a law firm and having attorney representation at your closing is even more important under these current circumstances.  Please do not hesitate to contact our office as every file and situation is unique. We continue to provide legal advice to our clients, alternative ideas, resolve conflicts, work on possible addendums and extensions needed.

We have found that meeting the contract timelines may be more difficult now. FAR has published a COVID-19 addendum which can be accessed in Forms Simplicity or by our office. This should be used if you believe that a timeline may not be met because of COVID-19.  Please feel free to contact our office if you need any clarification or questions about the content and potential use of this addendum.
